These Terms of Service ("Terms") govern your use of the Punctual Penguin service ("Service") operated by Zone2labs LLC ("we," "us," or "our"). The Punctual Penguin mobile application is licensed under Apple's Standard End User License Agreement available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms cover your use of our servers, your account, and any data stored therein.
By creating an account, you agree to these Terms.
Punctual Penguin provides task, project, and calendar management. The Service requires an account with data stored on our servers.
You must be at least 13 years old. You are responsible for maintaining your password confidentiality and all activity under your account. Notify us immediately of unauthorized access at punctual-penguin-support@zone2labs.com.
You retain ownership of tasks, projects, and calendar items you create ("Your Content"). You grant us a limited license to store and display Your Content solely to provide the Service. You are solely responsible for Your Content.

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that your data will never be lost.
To the maximum extent permitted by law, Zone2labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business interruption, arising from your use of the Service.
Our total liability shall not exceed fifty dollars ($50) or the amount you paid us in the past twelve months, whichever is greater.
You agree to indemnify and hold harmless Zone2labs LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
We are not responsible for loss of Your Content. While we make reasonable efforts to maintain data integrity, you are encouraged to keep your own backups.
We may modify, suspend, or discontinue the Service at any time without liability. We may terminate your account for any reason. You may delete your account by contacting us.
These Terms are governed by the laws of the State of Texas, United States. Disputes shall be resolved in the courts of Travis County, Texas.
We may update these Terms at any time. Changes will be posted at https://punctualpenguin.com/terms. Continued use constitutes acceptance.
